Every individual has constitutionally and statutorily protected rights when it comes to family-related legal matters. These rights include:
• Right to Legal Representation – Subject to Family Court discretion under Section 13 of the Family Courts Act.
• Right to Seek Maintenance – Under Section 125 of the CrPC or under personal laws, individuals can seek financial support from a spouse or guardian.
• Right to Child Custody & Visitation – Parents are entitled to apply for custody, guardianship, or visitation under relevant personal laws and Section 7(g) of the Family Courts Act.
• Right to Protection from Domestic Violence – Individuals have protection under the Protection of Women from Domestic Violence Act, with access to civil remedies via Family Courts.
• Right to Privacy in Proceedings – As per Section 11 of the Family Courts Act, proceedings can be conducted in camera for the protection of parties.
• Right to Appeal – Under Section 19, an appeal lies to the High Court on matters of law and fact (except consensual decrees or maintenance orders under CrPC).
